An area of fascination for me personally is the impact of Federal, State, and Local law on our individual freedoms. Viewing Aimee Bouchard’s Legal Consideration For BDSM video, highlighted the absurd catch-22 nature of laws regulating what a rational individual would choose to do with their own body. I believe in the concept that we own our body, that it is our property to use in whatever manner suits us, as long as no harm comes to others, either directly, or indirectly from our actions.
Given that in todays law and order society, it really doesnt matter if there is a specific law that allows or prohibits bdsm play. If your having a party at your house or attending one where flogging, caning, needle play, et al are happening, and a government official of some type walks in there is a high probability a lot of explaining will have to be done.
Any situation where the state creates the coercive laws on which charges are based, while at the same time the state is the arbiter of whether the law was actually broken, is a no win situation for anyone. Whether convicted or exonerated the individuals reputation, and financial security has been ruined.
Since our property includes our bodies, as well as anything we own, why do we cede control of it to the state. For example, say an arrogant Dom, or Top walked up to you and slapped a collar around your neck, gagged your mouth, and ordered you to perform tasks beyond your hard limits, what would your reaction be ? Most would be repelled at this provocation, resist, and fight back, and your friends might even come to your rescue. This analogy is essentially the relationship citizens have with the state; an ever more conforming, submissive population.
If I would want to start a business hosting pay for sex kink parties on my property, that inflicts no harm, nor forces anyone to do anything without their consent, then I should be allowed to. When people start talking about the decriminalization of prostitution, they stop short of emphasizing the private property issue. The only reason prostitution is illegal in the USA is there is too much profit to be made from it being illegal.
In the end consider how eroded our civil liberties have become. Its not too unrealistic to see actual laws on the books prohibiting the sales of bdsm gear, or even consensual S/M activities between two people.
